To Pay Rent or To Buy Groceries? That is NOT the Question!
By now, hopefully, we’re all beginning to adjust to our new respective daily “norms,” be it sharing the kitchen counter (aka the home office) with everyone that’s stuck home or competing with the cat for couch space. Kidding aside, these are challenging times and one big question is hanging in the air for those most impacted by COVID-19: What do I do about rent? It’s important to me that you’re all informed before making that choice.
On March 16th, New York State suspended all eviction proceedings and pending housing court orders “until further notice,” but this is NOT a rent freeze. What does that mean? Landlords, while unable to evict you, are still expecting your rent. And if you do not pay—at least as it currently stands—this means they may be able to begin eviction proceedings on the missed rent after housing courts re-open. We just don’t know which landlords will do what! So there are two main things to keep in mind:
ONE: If you’re in a dire financial situation where you have to choose between paying your rent or affording basic quality of life necessities like food or medicine, take care of you first! You are currently protected. Just know you technically owe that rent.
TWO: This is equally important, keep the lines of communication open with your landlord. If it’s only within your means to afford part of the rent, be it half or even a quarter, ask if you can do that instead. NYC and NYS are tenant-friendly in most situations, especially during this pandemic. Keep a record of everything you’ve discussed (or of your attempts if your landlord is unresponsive). This can be critical if your landlord does try to evict you later. If you speak on the phone, summarize what was agreed on in a follow-up email. Begin with something like: “To memorialize our conversation…” and end with a “Please correct any details if they are incorrect.”
