Kentucky officials are investigating a pro abortion organization after an airplane flew over the Kentucky State Fair advertising “Abortion Pills By Mail.”
The banner directed people to Mayday Health, a New York-based organization that provides information on obtaining abortion pills by mail. Kentucky Attorney General Russell Coleman says the group appears to be breaking state law and confirmed that his office has been investigating mail-order abortion pills since January.
Mayday Health argues its efforts are protected by the First Amendment.
This fight raises serious questions about states’ ability to enforce their own abortion laws when organizations operating elsewhere facilitate access across state lines.
The battle over abortion did not end when Roe v. Wade was overturned. It moved back to the states, where questions of life, federalism, enforcement, and constitutional authority continue to be fought.
